Massachusetts PFML private plans and overpayment tax questions

Hi all, hopefully someone can help me with these questions, I've been unable to get clarification anywhere.

I live in Massachusetts and changed companies mid year. My first company was contributing PFML (Paid Family and Medical Leave) which is required for Massachusetts. There was a line item on my pay stub that said “private PFML” and had a dollar amount. Apparently this means that this company did not pay into the Massachusetts system, but has a private plan, at least that is my understanding. The paycheck deductions are exactly the same as the Massachusetts PFML, and the paycheck deductions stop at the social security cutoff limit just like Massachusetts PFML.

This first company did not put the PFML amount in Box 14 on my W2 as Massachusetts requires. I was told by them that they did not have to do this since they have a private plan and are not paying into the Massachusetts system.

Now, my new company also has the PFML line item on my paystubs, and did put the PFML in Box 14 of my W2.

The end result here, is I overpaid Massachusetts PFML, but the first employer did not put the private PFML amount in box 14 of my W2.

Questions:

1) Does paying into PFML for the “private” plan for company 1 count against the total I’m supposed to pay for the year?

2) If (1) is yes, since Company 1 did not put pfml in box 14 on my W2, in order to get my tax software to accept it, I have to manually add it into box 14. I can get the amount from my last paycheck. Will this get me an audit? My guess is that is almost certainly will.

3) Is company 1 required by Massachusetts to put the private insurance amount paid in lieu of the Massachusetts system into box 14 on my W2? If so, they refuse to do this.

Looks like I'm out of luck on this one. I can't find any information anywhere on this, probably no precedent.....

Do you have access to your pay stubs? I'm in Mass and pay into this and the number "year to date" is on my last pay stub of the year.

If you have the paystub, save it and enter in the tax software.. If you get a letter from DOR, respond that it was paid and enclose copy of paystub

You've already discovered there is a way to recon this on your state taxes

Yes, I have this and this, the issue I'm having is how to enter it into the tax software. If I override the value, it won't let me e-file.

Thanks for the reply.
My concern is if I enter the pfml payment from my last paystub into the tax software, I have to enter it as if it was on the W2, otherwise the software will prevent me from e-filing.

My concern is this will trigger an audit. Now that being said, it likely won't trigger an audit from federal as box 14 is "informational only." So maybe the thing to do is just enter it as if it was on box 14 and let them call me out on it.

Federal won't care. IF MA sends you a letter about it, just document that you have the paystub proof. and reply back to them

I agree.
Unless I can get a corrected W2, this is the path I'm going to go down.
